Terms of Service
The agreement between you and Emwing GmbH: your account, plans and billing, the 14-day refund on yearly plans, what you own, and your rights as a consumer.
Who we are
The Emwing email service, including the web app at emwing.com, our desktop and mobile apps, the command palette, instant search, offline mode, Wingman hand-offs and every related feature (together, the “Service”), is provided by Emwing GmbH, Torstraße 140, 10119 Berlin, Germany (“Emwing”, “we”, “us” or “our”). Emwing GmbH is registered in the commercial register of the Amtsgericht Charlottenburg under HRB 245120 B. Our managing director is Lena Hartmann and our VAT identification number is DE 341 872 559.
These Terms of Service (the “Terms”) form a binding contract between you and Emwing GmbH. They apply whenever you create an account, sign in, use any part of the Service or visit emwing.com. Our Privacy Policy, Cookie Policy and Acceptable Use Policy form part of these Terms and are incorporated into them by reference.
You can reach us at support@emwing.com for help with the Service and at legal@emwing.com for anything relating to these Terms. The current version of these Terms is always available at emwing.com/terms, and you can print or save it at any time.
Accepting these terms
You accept these Terms when you create an account, when you tick the box confirming your agreement during sign-up, or when you otherwise use the Service. If you do not agree to these Terms, you must not use the Service.
You must be at least 16 years old to create an account or use the Service. By using the Service you confirm that you meet this requirement and that you have the legal capacity to enter into a binding contract.
If you use the Service on behalf of a company, association or other organisation, you confirm that you are authorised to accept these Terms on its behalf, and “you” in these Terms then also refers to that organisation. Where an organisation manages your account through a Squadron workspace, its administrators may have additional rights over your account, as described in the section on Squadron workspaces.
Nothing in these Terms limits any rights you have as a consumer under the mandatory laws of the country in which you normally live.
The service
Emwing is an email service designed for speed. It lets you send, receive, read, search, organise and archive email using single-key shortcuts, a command palette and a mouse or touch screen. Depending on your plan, the Service includes one or more @emwing.com addresses, storage for your mail, instant search, offline mode, Wingman hand-offs, custom domain support, shared inboxes, team snippets and administration tools.
To make search and navigation instant, the Service keeps an encrypted local cache of your mailbox on each device on which you use Emwing. You can manage or remove this cache at any time, as explained in our Privacy Policy.
We aim to keep the Service available around the clock, and we plan maintenance for quiet hours wherever we can. However, we do not guarantee that the Service will be uninterrupted, error-free or available at all times, unless we have agreed a specific service level with you in writing. Planned maintenance that we expect to affect availability for more than 30 minutes will be announced in advance within the Service.
We may occasionally offer features marked as “preview” or “early access”. These are provided so that you can try them before they are finished. They may change, be limited or be withdrawn at any time, and the availability commitments in these Terms do not apply to them.
Your account
To use the Service you need an Emwing account. You agree to provide accurate and complete information when you register, including a working recovery address, and to keep that information up to date. Each account is for one person and you must not share it with anyone else. Teams that want to work on the same mail should use shared inboxes or Wingman hand-offs on the appropriate plan.
You are responsible for keeping your password, passkeys, recovery codes and signed-in devices secure. We strongly recommend signing in with a passkey and using a password you do not use anywhere else. We will never ask for your password by email, text message or telephone.
You are responsible for all activity that takes place under your account, except where it results from our failure to protect the Service or from circumstances for which you are not at fault. If you become aware of any unauthorised access to your account, you must tell us promptly at support@emwing.com so that we can help you secure it.
Your @emwing.com address is chosen by you at sign-up, subject to availability. We may refuse or reclaim addresses that are misleading, that impersonate another person or organisation, that infringe the rights of others, or that are reserved for operational use (such as postmaster, abuse or admin).
If we cannot confirm that a request relating to an account comes from its rightful holder, we may refuse to act on it. Account recovery may require access to your recovery address, recovery codes or a registered passkey, and we may be unable to restore access where none of these is available.
Plans and prices
We currently offer three plans: (a) Glider, which is free and includes one @emwing.com address, 10 GB of storage, every keyboard shortcut, instant search and the command palette; (b) Jet, which costs $6 per month, or $5 per month when billed yearly ($60 per year), and adds offline mode, Wingman hand-offs, custom domain support and 100 GB of storage; and (c) Squadron, which costs $9 per person per month, or $7.50 per person per month when billed yearly ($90 per person per year), and adds shared inboxes, team snippets, administration and single sign-on, and 1 TB of storage per person.
The features, storage limits and prices of each plan are described on emwing.com/pricing at the time you subscribe. Prices are shown in US dollars. Where we are required to charge value added tax or another sales tax, we show it at checkout and add it to the price. For consumers in the European Union, the price shown at checkout includes any applicable VAT.
Glider remains free for as long as you use it in line with these Terms. We will not start charging for a free plan without your express agreement. If we ever withdraw the free plan, we will give you at least 90 days’ notice and a way to export all of your mail.
Storage limits apply per plan. If your account approaches its limit, we will warn you inside the Service and by email. If your account exceeds its limit, you will still be able to read, search, export and delete mail, but new incoming mail may be refused until you free up space or move to a larger plan.
Billing and renewal
Paid plans are billed in advance, either monthly or yearly, starting on the day you subscribe. Your subscription continues and renews automatically for successive periods of the same length until you cancel it. Each renewal is charged to the payment method on file on the first day of the new period.
We send you a reminder by email at least 7 days before each yearly renewal, setting out the date and the amount to be charged. You can cancel at any time before the renewal date in Settings → Plan and you will not be charged for the next period.
We accept the payment methods shown at checkout, which are processed by our payment provider. We do not store your full card number on our systems. You authorise us and our payment provider to charge the applicable fees to the payment method you provide.
If a payment fails, we will let you know and retry the charge over the following 14 days. If payment still cannot be collected, we may move your account to Glider. Your mail is kept, and features that are only available on paid plans are paused until payment is completed. We do not charge late payment fees to consumers.
For Squadron, you are charged for the number of seats in your workspace. Seats added during a billing period are charged pro rata for the remainder of that period. Seats removed take effect from the next billing period.
Invoices are available in Settings → Billing. Questions about a charge can be sent to billing@emwing.com.
Upgrades, downgrades and price changes
If you upgrade to a higher plan, the new features are available immediately. We credit the unused part of your current period against the price of the new plan and charge the difference straight away.
If you downgrade to a lower plan, the change takes effect at the end of the current billing period, and you keep the features of your current plan until then. Before a downgrade takes effect, you must bring your usage within the limits of the new plan. If your stored mail exceeds the new storage limit, the rules on storage limits in these Terms apply.
We may change the price of paid plans for future billing periods. We will give you at least 30 days’ notice of any price increase by email and within the Service. The new price applies from your next renewal after the notice period ends. If you do not agree to the new price, you can cancel before it takes effect and you will not be charged the higher amount.
Right of withdrawal, cancellation and refunds
If you are a consumer in the European Union, you have a statutory right of withdrawal: you may withdraw from a paid subscription within 14 days of the day the contract is concluded, without giving any reason. To exercise it, send a clear statement of your decision to billing@emwing.com or Emwing GmbH, Torstraße 140, 10119 Berlin, Germany, or use the cancellation button in Settings → Plan. It is sufficient to send your statement before the 14-day period has expired.
If you withdraw, we refund all payments received from you for that subscription without undue delay and no later than 14 days from the day we receive your withdrawal, using the same payment method you used, unless we expressly agree otherwise. You will not be charged any fee for the refund. Where you asked us to start the Service during the withdrawal period, we may deduct a proportionate amount for the Service provided up to the time of withdrawal, except that yearly plans are always refunded in full under the next paragraph.
Independently of the statutory right of withdrawal, and wherever you live, if you cancel a yearly plan within 14 days of purchase or of its yearly renewal, we refund the full amount paid for that year.
Otherwise, you may cancel a paid plan at any time in Settings → Plan. Cancellation takes effect at the end of the current billing period. You keep access to your paid features until then, after which your account moves to Glider and your mail is kept. Except as set out in this section or where required by law, fees already paid for a period that has started are not refunded.
If we end a paid subscription for reasons that are not your fault, or if we permanently remove a core feature of your plan, we refund the unused part of your prepaid fees pro rata.
Your mail is yours
You keep all rights in the messages, attachments, contacts, notes, snippets and other content that you send, receive or store using the Service (“Your Content”). We do not claim any ownership of Your Content.
You grant us a limited, non-exclusive, worldwide licence to store, copy, transmit, index, encrypt, back up and display Your Content, solely to the extent necessary to provide, secure and support the Service for you and for the people you choose to share it with, for example by delivering your messages, building your local search index or handing an email to a teammate through Wingman. This licence ends when Your Content is deleted from our systems, as described in our Privacy Policy.
We never read, scan or analyse Your Content for advertising, profiling or sale, and we never sell it to anyone. Our staff do not access Your Content except where you ask us to for support, where it is strictly necessary to investigate a security incident or a serious breach of our Acceptable Use Policy, or where we are required to do so by law. Such access is logged and limited to what is necessary.
You are responsible for Your Content and confirm that you have the rights needed to send and store it using the Service. Automated security checks, such as spam and malware filtering and the blocking of tracking pixels, run automatically on incoming mail to protect you; they do not involve people reading your mail.
You can export Your Content at any time in standard formats (MBOX for mail and vCard for contacts) from Settings → Export, free of charge and on every plan.
Encryption and security
Messages sent between two Emwing addresses are protected with end-to-end encryption, so their contents cannot be read by Emwing. Other mail is encrypted in transit wherever the other provider supports it, and all mail stored on our servers is encrypted at rest.
Because end-to-end encrypted content can only be unlocked with your keys, losing all of your sign-in methods and recovery codes may make that content permanently unreadable. We cannot recover end-to-end encrypted content on your behalf.
We protect the Service with appropriate technical and organisational measures, which we review regularly. If a personal data breach affects your data, we will inform you and the competent authorities where required by Regulation (EU) 2016/679.
Offline mode and your devices
On the Jet and Squadron plans, offline mode lets you read, search, reply to and archive mail without an internet connection, using the local cache on your device. Messages you send while offline are queued on your device and sent automatically when a connection is restored.
Queued messages are only sent once your device reconnects to the Service. We are not responsible for delays caused by your device remaining offline, or for messages lost because a device was reset, wiped or removed before its queue could be sent. The Service shows you how many messages are waiting to be sent.
You are responsible for the security of the devices on which you use Emwing. If a device is lost or stolen, you can sign it out remotely in Settings → Security → Devices, which also deletes its local cache the next time it connects.
Wingman and shared inboxes
Wingman lets you hand an email to another member of your team together with a note, so that you both can see who is responsible for it and discuss it alongside the message. Shared inboxes on the Squadron plan let several people read and answer mail sent to a common address.
When you hand off an email or add a message to a shared inbox, the people you share it with can read the message, its attachments and your notes. You are responsible for making sure you are entitled to share that content with them.
Hand-offs and shared inboxes are only available between members of the same Jet contacts list or Squadron workspace, as described in the Service. You must not use them to distribute content in breach of our Acceptable Use Policy.
Squadron workspaces
A Squadron workspace is created and managed by one or more administrators appointed by the customer that purchases it (the “Organisation”). The Organisation is our customer for that workspace and is responsible for paying for its seats.
Administrators can add and remove members, manage shared inboxes and snippets, configure single sign-on, enforce security settings, and, where permitted by applicable law and the Organisation’s own policies, access, export or delete mail stored in accounts within the workspace. If you use an account in a Squadron workspace, your use may be subject to your Organisation’s policies in addition to these Terms.
Where we process personal data on behalf of an Organisation, we do so as its processor under our Data Processing Agreement, which forms part of these Terms for Squadron customers and is available on request from legal@emwing.com.
If an Organisation removes you from its workspace or closes it, your access to accounts and mail in that workspace ends. Mail stored in an @emwing.com address you created personally before joining a workspace remains yours.
Custom domains and imported mail
On Jet and Squadron you can connect a custom domain to Emwing. You confirm that you own or are authorised to use any domain you connect, and you remain responsible for its registration, renewal and DNS settings. If your domain expires or its settings are changed, mail to that domain may stop reaching Emwing.
You can import mail, labels and contacts from other providers such as Gmail or Outlook by signing in to them through the Service. When you do, you authorise us to access and copy that content into your Emwing account on your behalf. We only use the access you grant for the import you requested, and we remove it once the import is complete or when you revoke it.
Third-party services you connect are provided by their own operators under their own terms. We are not responsible for their availability or for how they handle your data.
Acceptable use
You must use the Service in accordance with applicable law and our Acceptable Use Policy, which forms part of these Terms. In particular, you must not use the Service to send spam or unsolicited bulk mail, to phish or defraud, to distribute malware, to harass or threaten others, to infringe intellectual property or privacy rights, or to send or store unlawful content.
You must not attempt to gain unauthorised access to the Service, to other accounts or to our systems; interfere with or disrupt the Service; scrape, copy or reverse engineer the Service except to the extent permitted by mandatory law; circumvent sending limits or security measures; or resell or sublicense the Service without our written consent.
Sending limits apply to protect the reputation of Emwing mail for everyone. They are set out in our Acceptable Use Policy and may be adjusted where necessary to prevent abuse.
Our property
The Service, including its software, design, shortcuts, interface, text, graphics and the Emwing name, paper-plane logo and other trademarks, is owned by Emwing GmbH or its licensors and is protected by copyright, trademark and other laws.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for as long as your account is active. You must not copy, modify, distribute, sell or lease any part of the Service, or use our trademarks in a way that suggests endorsement or causes confusion, without our prior written consent.
If you send us feedback or suggestions, we may use them to improve the Service without any obligation to you. Doing so does not give us any rights in Your Content.
Privacy
We process your personal data in accordance with Regulation (EU) 2016/679 (the “GDPR”), the German Federal Data Protection Act (BDSG), and, where applicable, the California Consumer Privacy Act as amended by the California Privacy Rights Act. Our Privacy Policy, available at emwing.com/privacy, explains what personal data we collect, the purposes and legal bases for processing it, how long we keep it, and how you can exercise your rights of access, rectification, erasure, restriction, portability and objection.
Our Cookie Policy, available at emwing.com/cookies, explains the single strictly necessary cookie and the local storage used by the Service.
You can contact our data protection officer at dpo@emwing.com and lodge a complaint with a supervisory authority, including the Berlin Commissioner for Data Protection and Freedom of Information.
Liability
We are liable without limitation for damage caused intentionally or through gross negligence by us, our legal representatives or our agents; for injury to life, body or health; under the German Product Liability Act (Produkthaftungsgesetz); and to the extent we have given a guarantee.
For damage caused by slight negligence, we are only liable for breaches of material contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case, our limitation of liability restricts us to the typical damage that was foreseeable when the contract was concluded.
For customers who are not consumers, and to the extent permitted by law, our total liability arising from slight negligence in any 12-month period is limited to the amount you paid us for the Service in that period, or $100 for users of the free plan. We are not liable to non-consumer customers for indirect or consequential loss, loss of profit or loss of business opportunity caused by slight negligence.
We keep regular, encrypted backups of stored mail, but we recommend that you keep your own copies of important content. You can export your mail at any time.
Neither party is responsible for failure or delay in performance caused by force majeure, including natural disasters, pandemics, war, acts of terrorism, government action, failures of public networks or power supplies, or other events beyond its reasonable control, provided that it takes reasonable steps to limit the effects.
Indemnity
If you use the Service for business purposes, you agree to indemnify Emwing against claims made by third parties arising from Your Content or from your use of the Service in breach of these Terms or of applicable law, including reasonable legal costs, to the extent that you are responsible for the breach.
We will notify you promptly of any such claim, give you the opportunity to take part in its defence, and not settle it without consulting you. This section does not apply to consumers.
Suspension and termination
You can close your account at any time in Settings → Account → Close account. If you have a paid plan, the rules on cancellation and refunds in these Terms apply.
We may suspend or restrict your account, in whole or in part, if we reasonably believe that you have seriously or repeatedly breached these Terms or our Acceptable Use Policy, that your account has been compromised, or that suspension is necessary to protect other users, the Service or the deliverability of Emwing mail. Where possible, we will tell you in advance, explain the reason and give you an opportunity to remedy the problem.
We may terminate your account for good cause with immediate effect, in particular in cases of serious abuse such as spam campaigns, phishing, the distribution of malware or the use of the Service for criminal purposes. We may terminate a free account that has not been signed in to for 24 months, after giving at least 30 days’ notice to your recovery address.
Unless prohibited by law or where there is a serious risk of harm, we will give you at least 30 days after termination to export Your Content before it is deleted. If you believe we have suspended or terminated your account in error, you can appeal by writing to abuse@emwing.com, and a person will review your case.
The sections of these Terms that by their nature should continue after termination, including those on your content, liability, indemnity and disputes, continue to apply.
What happens when you leave
Before closing your account, we recommend that you export your mail and contacts from Settings → Export. Once you close your account, it enters a 30-day grace period during which you can reopen it by signing in. After that, your account and Your Content are permanently deleted from our live systems, and deleted data is purged from our backups within a further 30 days.
Your @emwing.com address is not reassigned to anyone else for at least 12 months after deletion, to protect you from mail intended for you reaching a stranger.
We keep billing records for as long as required by German commercial and tax law, as described in our Privacy Policy.
Changes to the service and to these terms
We continuously develop the Service and may add, change or remove features. We will not make changes that materially reduce the core features of a paid plan during a billing period you have already paid for, except where required for legal or security reasons.
We may change these Terms where there is a valid reason, such as changes in the law, in court decisions, in the Service or in market conditions, provided that the change is reasonable for you. We will notify you of material changes by email and within the Service at least 30 days before they take effect.
If you do not agree to a change, you can close your account or cancel your plan before it takes effect, and we will refund any prepaid fees for the period after the change. If you continue to use the Service after the change takes effect, the updated Terms apply. We will remind you of this consequence in our notice.
Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you have your habitual residence.
If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from these Terms is Berlin, Germany. Consumers may bring proceedings in the courts of their country of residence.
If you have a complaint, please contact us first at legal@emwing.com. We will acknowledge it within 3 working days and aim to resolve it within 30 days.
The European Commission provides a platform for online dispute resolution, available at https://ec.europa.eu/consumers/odr. Emwing GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). We prefer to resolve every concern directly with you.
The fine print
These Terms, together with the policies incorporated into them and any order form or agreement you sign with us, form the entire agreement between you and Emwing regarding the Service and replace any earlier agreements on the same subject.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision is replaced by the statutory provision that comes closest to its purpose.
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights and obligations to a company in our group or to a successor in connection with a merger, acquisition or sale of assets, provided that your rights under these Terms are not reduced; we will tell you in advance.
Nothing in these Terms creates a partnership, employment or agency relationship between you and us. Headings are for convenience only. You agree that we may communicate with you electronically, including by email to your Emwing address and your recovery address, and that such communications satisfy any requirement for written form to the extent permitted by law.
These Terms are provided in English. Where we provide a translation, the English version prevails to the extent permitted by law.
